The Palestinian cause has become a wound to the Palestinians alone, and the only means for the Arabs to trade and bargain and achieve their only goal.. It is not a prosperous economy, nor a repulsive development, nor a manifestation of existence, and hegemony over the Palestinian cause and robbed it of the aggressors and returned it to its people.. But the goal is to remain in power until the end of the world ...and let the Palestinian cause go to hell, and let the seat of government remain... It is the truth that the developments of the Palestinian cause reveal to us every day, and we are satisfied with the normalization of the Arab countries that used to stand out in international forums and call for the rights of the Palestinians.

Many years ago, and until today, the Israeli violations against the Palestinians and their sanctities have not ended.. It is not surprising that we see every day news of an attack or an attack. Rather, we expect more and more, and the Arab governments are no longer idly by, but rather their movement to shake hands and cooperate with this entity.. The matter is no longer It is confined to denying one of the legitimate rights, such as the right of return.

Arrest and abuse.. Shelling and demolition of homes.. Continuous crimes affecting young children, adults kneeling, and cuddling animals.. All human standards have become ink on paper and slogans only.. And the Zionist entity continues, with no limits to stop it.

This is a set of Israeli violations. As for the Arab dealings with the Palestinian issue, it has cooled down.. It is not like their dealings with Ukraine today, and not like their dealings with the events of a few hours before the events of a century ago!! The issue of Israel’s occupation of Palestine is not only the focus of the issue, but this issue is a title for issues of robbery of rights, aggression against humanity and the execution of identity, and the Arabs are watching and even contributing. From then to this day The Palestinian issue remained the most complex Arab issue, and a coin remained in the hands of the Arabs... until Israel achieved the goal of seizing and by force what was left of the Arab land from time immemorial, and it is the land of the Palestinians' right only to weigh others..

In talking about the type of Palestinian immigration, and in contrast to the Israeli allegations and allegations that this immigration is voluntary, the academics concerned with the study of immigration confirmed that it was a forced migration resulting from a forced act, in which intimidation, massacres, and humanitarian and military attacks were used. Their homelands are voluntary migration, which is nothing but a pretext to evade international responsibility, which is forced displacement by force of arms and violation of rights in illegal ways... As under international law, Israel bears all the legal, political and humanitarian consequences for the continuation of the refugee problem to this day, creating a problem Palestinian asylum, which has become the problem of the neighboring Arab countries, most notably Lebanon.

The idea of ​​return has been the driving force of the Palestinian struggle for decades, and the right of return is an inherent right that no one can dispute or prevent refugees from returning in accordance with the provisions of international law.

The right of return is a legal right

We are talking about a right, and all the details of this right are internationally recognized and there is no dispute about it.. This right is enshrined in the majority of international and regional covenants that make up international human rights law, the most important of which are:

1. Universal Declaration of Human Rights International Covenant on Civil and Political Rights (1966).

2. International Treaty on the Elimination of All Forms of Racial Discrimination (1965).

3. The American Treaty of Human Rights.

4. African Charter on Human and Peoples' Rights.

5. Fourth Protocol to the European Convention for the Protection of Human Rights and Fundamental Freedoms.

 

This right is subordinate to private property, which does not disappear by occupation or the imposition of sovereignty on the country.. It is a right that does not fall into statute by prescription, no matter how long the period, except that the Palestinians have been deprived of it..

 We recall in this regard that after the issuance of Partition Resolution “181” by the United Nations General Assembly on (29/11/1947), the General Assembly, based on the recommendation of the international mediator, Count Bernadotte, issued its famous Resolution No. (194) related to the right of return (12/11). 1948), which was opposed by all the Arab countries represented in the General Assembly of the United Nations, and at the time were Egypt, Iraq, Lebanon, Saudi Arabia, Syria and Yemen, in addition to the rejection of this resolution by the Palestine Liberation Organization.

Paragraph 11 of the resolution stated that the refugees wishing to return to their homes should be allowed to return at the earliest time, and that compensation should be paid for the properties of those who decide not to return to their homes.. However, this decision was unjust, and it did not force Israel to implement the provisions stipulated in the resolution He called for a kind of peaceful coexistence with the neighbors, ie the Jews.

There is no doubt that Resolution 194 played an important role in safeguarding the refugee issue and their rights over a period of time, and constituted an entry point for raising the refugee issue every year in the regular session of the United Nations General Assembly.

The United Nations has classified this right as a purely human right and it is one of the rights that cannot be disposed of, and this means that it is a right inherent to human dignity and does not need to be recognized and it is not permissible for others to dispose of it.

We conclude by saying that this right is a right that is not subject to bargaining or bartering... But the Arab countries bargained, bargained, and tolerated this right...

This decision does not distinguish between the 48 refugees and the 67 refugees, and it addresses the Palestinian refugees as One group, and more than that, the resolution uses the term "the Palestinian people" instead of the term "Palestinian refugees."

We repeat and say that the right to return to the homeland is a basic human right that does not fall into obsolescence, no matter how long it takes. This right has been recognized by a large number of international human rights treaties.

The rules of this law do not initially allow for the expulsion of civilians, whether individual or collective expulsion, and this is what was stipulated in Article 9 of the Universal Declaration of Human Rights of 1948.

Return is a legitimate right and a right that cannot be discussed. Talking about this right cannot be limited to the lines of this article.
